City-wise HRA Exemption Guide

For tax exemption purposes, the Income Tax Department classifies Indian cities into Metro and Non-Metro. Metro cities receive a 50% basic salary exemption allowance, whereas all other cities receive 40%:

ClassificationApplicable CitiesHRA Exemption Limit
MetroDelhi, Mumbai, Kolkata, Chennai50% of Basic + DA
Non-MetroBangalore, Hyderabad, Pune, Gurgaon, Noida, and all other Indian cities40% of Basic + DA

The Three-Way HRA Exemption Formula

Under Section 10(13A) of the Income Tax Act, the tax-exempt portion of your HRA is the minimum of the following three amounts:

  1. Actual HRA Received: The exact HRA allowance provided by your employer in your salary slip.
  2. Actual Rent Paid minus 10% of Basic Salary: Calculated as (Total Rent Paid) - (10% of Basic Salary + DA).
  3. Percentage of Basic Salary: 50% of Basic Salary if you live in a Metro city (Delhi, Mumbai, Chennai, Kolkata), OR 40% if you live in a Non-Metro city.

Worked Example: Metro vs Non-Metro

Scenario: Basic Salary: ₹50,000 | HRA Received: ₹20,000 | Actual Rent Paid: ₹15,000

Case 1: Living in Mumbai (Metro)

  • 1. Actual HRA: ₹20,000
  • 2. Rent - 10% Basic (15000 - 5000): ₹10,000
  • 3. 50% of Basic: ₹25,000
  • Exempt HRA (Minimum of above): ₹10,000

Case 2: Living in Pune (Non-Metro)

  • 1. Actual HRA: ₹20,000
  • 2. Rent - 10% Basic (15000 - 5000): ₹10,000
  • 3. 40% of Basic: ₹20,000
  • Exempt HRA (Minimum of above): ₹10,000

Important PAN Card & Proof Requirements

To successfully claim HRA tax exemptions, you must comply with standard documentation guidelines:

  • Landlord PAN Card: If your total annual rent paid exceeds ₹1,00,000 (approx. ₹8,333 per month), providing the landlord's Permanent Account Number (PAN) is mandatory for tax auditing.
  • Rent Agreement: A valid, signed lease or rent agreement outlines the terms of your tenancy and is the primary proof of rent.
  • Rent Receipts: Keep monthly rent receipts signed by your landlord, especially for cash payments. For bank transfers, bank account statements are also valid secondary evidence.

How to Claim HRA if Employer Doesn't Allow It

If you missed submitting rent proofs to your employer on time, you can still claim HRA tax exemption directly when filing your Income Tax Return (ITR). Recalculate your taxable salary income by subtracting the eligible HRA exemption and enter the adjusted taxable income in the ITR portal.

Frequently Asked Questions

Can I claim HRA if I live with my parents?

Yes, you can claim HRA by paying rent to your parents. You must have a formal rent agreement with them and transfer the money to their bank account monthly. Your parents will have to declare this rent as income when they file their taxes.

Can I claim both HRA and Home Loan benefits?

Yes, you can claim both HRA and home loan deduction (Section 24b and 80C) simultaneously. This is typically allowed if your own house is in a different city, or if you cannot reside in your own house for genuine work-related reasons.

Is HRA available under the New Tax Regime?

No. The New Tax Regime does not allow deductions for House Rent Allowance (HRA) or Leave Travel Allowance (LTA). If you opt for the New Regime, your entire HRA becomes fully taxable.

What if my landlord refuses to give their PAN?

If your annual rent is above ₹1 Lakh and your landlord refuses to provide their PAN, you will not be able to claim the HRA exemption for rent paid over ₹1 Lakh. To avoid issues, always ask for the PAN before signing the lease.

Do I need to submit original rent receipts?

Most employers accept scanned copies or digital uploads of rent receipts through their internal payroll portals. However, you should keep the physical originals safe in case the Income Tax Department asks for proof during an audit.

Can self-employed individuals claim HRA?

Self-employed professionals do not receive a salary, so they cannot claim HRA under Section 10(13A). However, they can claim rent deduction under Section 80GG, subject to a maximum of ₹5,000 per month.

Is maintenance charge included in rent for HRA?

No. Maintenance charges, electricity bills, or water bills paid to the landlord or society cannot be included in the 'rent paid' for HRA calculation. Only the core rent amount is eligible.

What if I own a house in the same city?

If you own a house in the same city but choose to live in a rented apartment, you can still claim HRA provided you actually pay rent and can prove you reside in the rented property, not your own.
